To the Academic Senate, = Los Angeles=20 Division:

The Academic Senate = Executive Office=20 has been engaged in a broad analysis of its information technology=20 requirements. The Academic Senate is moving toward an Executive = Office=20 environment in which the web page, Senate document storage and = retrieval,=20 voting, Senate grants, etc., are electronically administered in such a = way that=20 meets the needs of the faculty while minimizing duplication of efforts = on behalf=20 of staff. This piece of legislation is one element of a broader = Academic=20 Senate IT initiative. The current state of the Academic Senate=92s = IT=20 infrastructure does not allow for appropriate levels of security. = In order=20 to ensure that online voting is conducted in a secure manner, the = following=20 revisions are required and requested.

Justification

The current language of = Bylaw 155,=20 Section E, does not adequately establish security parameters regarding = the=20 electronic voting for the Academic Senate. The proposed bylaw = revisions=20 are intended to address this inadequacy while enhancing the role the = Elections=20 Commissioner plays in providing oversight for the voting information = technology=20 in order to ensure the integrity of elections. Moreover, the = proposed=20 language enables the utilization of future technology and improved = systems in=20 order to continually provide for secure, reliable, and smooth voting and = tallying processes.

(E)=20 In the event of a written ballot distributed by = mail, each=20 voter receives a single envelope addressed to the Elections = Commissioner=20 of the Division. This envelope provide space for the name of the=20 department and the signature of the voter. Envelopes lacking the = signature=20 are void. To ensure secrecy, the Elections Commissioner will be = present at=20 the time of opening and counting the ballots. All ballots will be = removed=20 from the envelopes prior to the counting of any ballots. On = petition of 1%=20 of all eligible voters, a two-envelope ballot procedure will be = used for a=20 specified election. Each voter receives a plain envelope in which = to=20 enclose the marked ballot, and a further envelope addressed to the = Elections Commissioner of the Division. The latter envelope = provides space=20 for the name of the department and the signature of the voter. = Envelopes=20 lacking this signature are void. The system = shall=20 be designed to that once a vote has been cast, neither the voter = nor=20 anyone with access to the system will be able to change the vote. = Should a=20 Senate member prefer a hard copy ballot, the Senate will make one=20 available upon request. In case a voter submits both an electronic = and a=20 paper ballot, the electronic ballot takes precedence and the paper = ballot=20 will be destroyed prior to the count. [En 08 Apr = 03]

The system shall be designed to so that once a vote has = been cast=20 it immediately will be = recorded so=20 that neither the voter nor anyone with access to the = system=20 will be able to change the vote. ~~Should a Senate member prefer = a hard=20 copy ballot, the Senate will make one available upon = request. =20~~ Upon request, hard = copy=20 ballots shall be provided for those Senate members who do not have = access=20 to electronic voting. In case a voter submits = both an=20 electronic and a paper ballot, the electronic ballot takes = precedence and=20 the paper ballot will be destroyed prior to the count.
